Removals Germany UK Service Terms and Conditions

These Terms and Conditions set out the basis on which Removals Germany provides household and commercial removals, packing, transport, and related services within the United Kingdom and between the UK and Germany. By making a booking, you confirm that you have read, understood, and agree to these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Company means Removals Germany, the removal service provider. Customer means the person, firm, or company requesting the services of the Company. Services means removal, packing, loading, transport, unloading, storage, and any other related services agreed in writing. Goods means the items and personal effects which the Company agrees to move, handle, or store. Contract means the agreement between the Company and the Customer incorporating these Terms and Conditions.

2. Scope of Services

The Company provides domestic and commercial removals, including UK local moves and moves between the UK and Germany, packing and unpacking, loading and unloading, transport, and, where agreed, temporary storage and associated services. The precise scope of Services will be set out in the written quotation or booking confirmation.

3. Quotations

All quotations are based on the information provided by the Customer and are subject to survey where applicable. Quotations are normally issued in writing and are valid for a limited period as stated in the quotation. If no period is stated, the quotation is valid for 30 days from the date of issue, subject to availability.

Quotations are based on normal access, reasonable lifting distances, and the volume and nature of Goods declared by the Customer. The Company reserves the right to amend the quotation or apply additional charges if:

The information provided by the Customer is incomplete, inaccurate, or changes. Access at either property is significantly restricted, requires additional equipment, or involves unusual difficulty. Additional Services are requested or required on the day of the move. There are delays outside the Company’s control, including but not limited to waiting for keys, delayed access, traffic incidents, or regulatory checks.

4. Booking Process

A booking is only confirmed when the Customer has accepted the quotation in writing or via the agreed booking method, and the Company has issued a booking confirmation. Verbal quotations or provisional bookings do not constitute a binding Contract.

The Customer is responsible for checking that all details in the quotation and booking confirmation are correct, including addresses, dates, access information, and the volume and nature of Goods. Any discrepancies must be notified to the Company as soon as possible and in any event before the Services commence.

The Company may refuse or cancel a booking if it believes that the Services cannot be carried out safely, lawfully, or in accordance with relevant regulations, or if the Customer is in breach of these Terms and Conditions.

5. Customer Responsibilities

The Customer agrees to:

Provide accurate information about the volume, nature, and value of the Goods, and about access and parking at both collection and delivery addresses. Ensure that appropriate parking and any necessary permits, authorisations, or permissions are arranged in good time, unless otherwise agreed in writing. Ensure that all Goods are properly packed, clearly labelled, and ready for loading, unless packing services have been specifically requested and included in the quotation. Disconnect, defrost, and drain appliances such as fridges, freezers, washing machines, and dishwashers, unless otherwise agreed. Remove and safely secure any fixtures, fittings, or items that require professional disconnection, such as gas appliances, electrical fittings, or plumbing. Be present, or ensure that a responsible adult authorised by the Customer is present, at collection and delivery to direct the crew and sign relevant documentation.

6. Items Not Accepted for Removal

Unless expressly agreed in writing, the Company will not carry or store:

Hazardous, toxic, or flammable substances, including paint, solvents, gas cylinders, petrol, or chemicals. Illegal items, contraband, or any items whose possession or transport is unlawful. Cash, securities, precious metals, jewellery, or valuable collections. Perishable items, live animals, plants, or food requiring refrigeration. Explosives, firearms, ammunition, or weapons.

If such items are transported without the Company’s knowledge, the Company shall have no liability for loss, damage, or delay arising from their presence, and the Customer shall indemnify the Company against any loss, damage, claims, or expenses arising from their inclusion.

7. Payments and Charges

Unless otherwise agreed in writing, a deposit may be required at the time of booking, with the balance payable before the commencement of the Services. The payment schedule will be set out in the quotation or booking confirmation.

All charges are exclusive of any applicable taxes, duties, tolls, or customs charges unless stated otherwise. The Customer is responsible for any customs duties, import or export charges, or additional regulatory fees arising in connection with moves between the UK and Germany.

If payment is not received by the due date, the Company reserves the right to:

Cancel or suspend the Services. Charge interest on overdue amounts at the statutory rate from the due date until payment is received in full. Retain a lien over the Goods until payment is made and, after giving reasonable notice, arrange for their sale or disposal to recover outstanding amounts.

8. Cancellations and Postponements

The Customer may cancel or postpone the Services, subject to the following conditions, unless otherwise agreed in writing:

If the Customer cancels more than 14 days before the agreed date, any deposit paid may be refunded, less any reasonable administration or survey costs incurred. If the Customer cancels between 7 and 14 days before the agreed date, the Company may charge up to 50 percent of the quoted price. If the Customer cancels less than 7 days before the agreed date, the Company may charge up to 100 percent of the quoted price.

Any cancellation or postponement must be notified in writing via the agreed communication method. The Company may, at its discretion, offer alternative dates or apply part of any cancellation charge towards a rescheduled booking.

The Company reserves the right to cancel or postpone the Services due to circumstances beyond its reasonable control, including but not limited to extreme weather, road closures, accidents, mechanical breakdown, industrial action, or regulatory restrictions. In such cases, the Company will aim to offer an alternative date or refund any amounts paid for Services not provided, but shall not be liable for consequential loss.

9. Access, Parking, and Delays

The Customer is responsible for ensuring that suitable access and parking are available at both collection and delivery addresses. This includes arranging any necessary permits or permissions from local authorities or property managers.

If access is restricted or unsuitable, or if waiting time arises due to events outside the Company’s control, additional charges may apply based on the Company’s standard hourly rates.

The Company will use reasonable efforts to adhere to agreed arrival and delivery times but cannot guarantee precise times due to the nature of transport, traffic conditions, and regulatory checks associated with international removals between the UK and Germany. Time is not of the essence unless expressly agreed in writing.

10. Packing and Customer-Packed Goods

If the Company has agreed to pack the Goods, it will do so with reasonable care using suitable materials and methods. The Customer must inform the Company if any item is fragile, of high value, or requires special handling.

Where the Customer opts to pack some or all of the Goods, the Customer is responsible for ensuring that items are adequately and safely packed for transport. The Company is not liable for damage arising from poor or inadequate packing by the Customer or by third parties instructed by the Customer.

11. Liability and Limits of Responsibility

The Company will exercise reasonable skill and care in providing the Services. Its liability for loss of or damage to the Goods, or for delay, shall be limited as follows unless a higher value has been declared and additional cover arranged in writing.

The Company’s liability for loss of or damage to Goods is limited to a reasonable cost of repair or replacement, taking into account age, condition, and depreciation, and subject to an overall cap per consignment as stated in the quotation or booking confirmation.

The Company shall not be liable for:

Loss or damage arising from inherent defects, pre-existing damage, wear and tear, or the nature of the Goods. Loss or damage to items which are brittle, delicate, improperly assembled, or not suitable for transport. Loss of profits, loss of income, or any indirect or consequential loss. Loss or damage resulting from war, terrorism, civil commotion, natural disasters, or other events beyond the Company’s reasonable control.

The Company is not liable for any loss or damage unless the Customer notifies the Company in writing of the loss or damage within a reasonable time. For obvious loss or damage visible on delivery, this should be recorded at the time of delivery where practicable.

12. International Removals and Customs

For moves between the UK and Germany, the Customer is responsible for ensuring compliance with all customs, import, and export regulations and for providing accurate declarations and documentation. The Customer must disclose any items that may be subject to restrictions, duties, or prohibitions.

The Company is not responsible for any delay, seizure, or confiscation arising from inaccurate or incomplete customs declarations or from the inclusion of prohibited or restricted items. Any additional charges, duties, or penalties imposed by customs or regulatory authorities will be the responsibility of the Customer.

13. Waste, Disposal, and Environmental Regulations

The Company operates in accordance with applicable UK and relevant European waste and environmental regulations. The Company is not a general waste carrier and will only remove and dispose of items agreed in advance as part of the Services.

Where the Customer requests disposal of unwanted items, this will be treated as an additional service and may attract separate charges. The Company will arrange disposal through appropriate channels and licensed facilities where applicable.

The Customer must not include hazardous waste, clinical waste, or any materials which require specialist handling or disposal without the Company’s prior written agreement. If such items are discovered, the Company may refuse to carry or dispose of them and may charge for any costs incurred in handling or making the items safe.

14. Storage Services

Where storage is provided, Goods will be stored in facilities selected by the Company. The Customer must ensure that contact details remain up to date during any storage period.

Storage charges will be payable in advance or as otherwise agreed. If storage payments are overdue, the Company may exercise a lien over the Goods and, after giving reasonable written notice, may sell or dispose of them to recover unpaid charges and associated costs.

15. Complaints and Claims

If the Customer is dissatisfied with any aspect of the Services, they should raise the matter with the Company as soon as possible so that it may be investigated and, where appropriate, resolved.

Any claim for loss of or damage to Goods, or for delay, must be made in writing and supported by reasonable evidence. The Company may require photographs, receipts, or other documentation before assessing or settling a claim.

16. Data Protection and Privacy

The Company will process personal data provided by the Customer for the purposes of administering bookings, providing Services, managing accounts, and complying with legal obligations. Personal data will be handled in accordance with applicable data protection laws.

The Company may share relevant information with subcontractors, insurers, and regulatory authorities where necessary for the performance of the Contract or compliance with legal requirements.

17. Subcontracting

The Company may subcontract all or part of the Services to carefully selected partners, in particular for international transport between the UK and Germany. The Company will remain responsible for the performance of the Contract, subject to the limitations of liability set out in these Terms and Conditions.

18. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with any Services provided by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

19. General Provisions

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. No failure or delay by the Company to exercise any right or remedy shall constitute a waiver of that or any other right or remedy.

These Terms and Conditions, together with the quotation and booking confirmation, constitute the entire agreement between the Company and the Customer and supersede any prior understandings or representations, whether oral or written.

The Company reserves the right to update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the Contract, unless otherwise agreed in writing.
